Generative AI-Powered Feature Consent
Utilizing this generative artificial intelligence powered feature or functionality (hereinafter, the “AI-Powered Features”), whilst made available within a Watermark product, is at all times subject to user acknowledgment and compliance with these terms (the, “Consent”).
Watermark is committed to providing transparent, ethical and responsible AI, aligning to the NIST AI Risk Management Framework. As such, you are receiving this Consent because AI-Powered Features include generative artificial intelligence (AI) that is defined as a broad category of AI capable of generating new content such as code, images, text, etc.
1. AI-Powered Features.
AI algorithms may enhance your user experience, including but not limited to receiving predictive suggestions, content recommendations, and data analysis. By using AI-Powered Features, you acknowledge that you: (a) have the legal capacity to comply with and agree to these terms; and (b) are not a minor in the jurisdiction in which you reside. If you do not meet (a) and (b), do not use the AI-Powered Features within the Watermark product.
2. Data Collection and Usage.
AI-Powered Features, are provided using third-party AI tools, including Microsoft Azure, to collect and process the data that you provide, as well as data generated through your interactions with the AI-Powered Features. This data may include text inputs, usage patterns, selections, preferences, and other relevant information. You should not input any personal or sensitive information, including names, phone numbers, addresses, emails, or birth dates into any AI-Powered Features. User discretion is advised before relying on, publishing, or otherwise using AI-generated content.
3. Data Sharing.
Data will not be shared or sold with Watermark third-parties for marketing purposes. Watermark may use and share anonymized, de-identified, and aggregated metrics and data to improve AI algorithms, to enhance Watermark product functionality, or to improve other Watermark services. Microsoft Azure processes AI-Powered Feature data in accordance with the Microsoft Privacy Statement currently available at the Microsoft AI Trust Policy.
4. Warranty Disclaimer.
Neither Watermark nor the applicable AI tool make any warranties regarding the availability of the features. TO THE EXTENT ALLOWED BY APPLICABLE LAW, WE PROVIDE PRODUCTS AND SERVICES “AS IS” WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FOR EXAMPLE, WE DON’T MAKE ANY WARRANTIES ABOUT THE CONTENT ARISING OUT OF THE AI-POWERED FEATURES OF ANY PRODUCT OR SERVICE, INCLUDING THEIR ACCURACY, RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS.
5. AI-Powered Feature Availability.
Neither Watermark nor the applicable AI tool make any representations regarding the availability of the features.
6. Opt-In and Opt-Out Control.
Users will be prompted to acknowledge this Consent (the “Opt-In”) prior to accessing AI-Powered Feature. If you decide to withdraw your consent for AI-Powered Features at any time, you may do so within the product or contact firstname.lastname@example.org (an “Opt-Out”).
7. Version Control.
This AI-Powered Feature Consent will be updated from time to time to reflect changes in technology, law, and/or Watermark’s evolving business practices. By continuing to use the Product, you acknowledge that you have read and understood this AI Consent and agree to the terms herein.
