Registration Terms & Conditions

June 4-6, 2025

 

Watermark Insights, LLC (“Watermark”) will hold Watermark Engage 2025 (“Engage”) at the Mayflower (the “Venue”) in Washington, D.C. on June 4 – 6, 2025. By registering for Engage, all attendees, including sponsors, agree to the following terms and conditions.

Payment Options Info

We accept Visa, MasterCard, American Express. Credit cards are charged at the time you register online. If you need to pay via PO, please reach out to engage@watermarkinsights.com.

Cancellation Policy

No refunds will be issued for cancellations. Please remember that canceling or changing your registration will not automatically cancel any hotel or travel arrangements. You are solely responsible for canceling your own hotel room and/or airfare cancellation and such cancellations must be made directly with the individual hotel or airline. You are subject to any third party airline or hotel refund/cancellation policies.

If you do not attend the event and did not cancel or change your registration but have paid your registration fee, you will not be refunded.

Watermark reserves the right, at its sole discretion, to verify your relationship with Watermark, and to determine if your attendance is appropriate. Please bring identification to the in-person event check-in.

Data Sharing

Watermark is committed to data privacy and protecting your personal information. How we collect, process, and use your data is included in the Watermark Privacy Policy currently available at https://www.watermarkinsights.com/legal/privacy-statement/. By registering, you are agreeing that Watermark may contact you directly with information about the event, and marketing content about its products and services.

By registering and attending the event, you consent to Watermark sharing certain personal information with participating sponsors, unless you explicitly opt-out during registration. Not opting out means Watermark may share your registration details in an attendee list, which includes your first name, last name, title, and company (as provided by the attendee).

Sponsors receiving attendee data are advised to treat the attendee data confidential, and are asked not to share the attendee list with any third parties. You may be contacted by the sponsors of this event, and can exercise your right to opt-out or be forgotten, if applicable, directly with the sponsor.

Substitution Policy

Transfer of registrants will be permitted as long as both individuals are from the same institution and the request is received prior to May 8, 2025. Contact engage@watermarkinsights.com to request a substitution. Please include your name, company name, and registration number.

Photography, Audio, and Video Recording

By registering for Watermark Engage, you authorize Watermark to use your likeness, photograph, voice, name, or video of you for future marketing materials. You agree and accept that such photographs or videos may be used by Watermark for internal and public purposes, and no remuneration will be provided for use of your image. By participating in the event, you agree and consent to this clause in perpetuity. Further, you waive the right to bring action of any kind in law or equity against Watermark.

Speakers and Presenters

By participating in Engage as a Speaker, you give permission to Watermark to use your presentation, written or verbal endorsement, name, image, and/or likeness, Client name, Client logo, any presentation, trademark or trade name, in connection with the event. You expressly authorize Watermark may use, copy, exhibit, publish, and distribute such content, in whole or in part, in print, in any format, including sharing on the internet, social media, websites, and apps), and in all other media now known or hereafter existing for advertising, marketing, publicity, and promotion of Watermark and its products/services/brands and all other commercial business purposes.

Liability Waiver & Release

In consideration for registering, and participating in the event, you hereby warranty and represent you are age 18 or above, and freely waive, release from all liability, assume all risks, and covenant not to sue Watermark or its members, employees, board members, agents, or volunteers for any experience, loss, damage, personal injury, illness, property damage, of any kind. This waiver and release is specifically binding upon your heirs and assigns and is knowingly given.

Health and Safety Information

YOU HEREBY EXPRESSLY WAIVE AND RELEASE ANY AND ALL CLAIMS, NOW KNOWN OR HEREAFTER KNOWN, AGAINST WATERMARK INSIGHTS, LLC AND ITS AFFILIATES (COLLECTIVELY, “WATERMARK” OR THE “COMPANY”), INCLUDING ITS OFFICERS, DIRECTORS, MANAGER(S), EMPLOYEES, AGENTS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, “RELEASEES”), ON ACCOUNT OF INJURY, DISABILITY, DEATH, OR PROPERTY DAMAGE ARISING OUT OF OR ATTRIBUTABLE TO YOUR PARTICIPATION IN THE ENGAGE ACTIVITIES, WHETHER ARISING OUT OF THE ORDINARY NEGLIGENCE OF THE COMPANY OR ANY RELEASES OR OTHERWISE. YOU COVENANT NOT TO MAKE OR BRING ANY SUCH CLAIM AGAINST THE COMPANY OR ANY OTHER RELEASEE, AND FOREVER RELEASE AND DISCHARGE THE COMPANY AND ALL OTHER RELEASES FROM LIABILITY UNDER SUCH CLAIMS. THIS WAIVER AND RELEASE DOES NOT EXTEND TO CLAIMS FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR ANY OTHER LIABILITIES THAT TEXAS LAW DOES NOT PERMIT TO BE RELEASED BY AGREEMENT.

BY REGISTERING, YOU ACKNOWLEDGE THAT YOU HAVE READ AND FULLY UNDERSTOOD ALL OF THE TERMS OF THIS RELEASE AND THAT YOU ARE VOLUNTARILY GIVING UP LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE COMPANY, WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO YOU. YOU INTEND THIS REGISTRATION TO BE THE REQUIRED EVIDENCE OF YOUR ASSENT TO COMPLETELY AND UNCONDITIONALLY RELEASE ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.

Admittance

In its sole discretion and without refund or liability, Watermark reserves the right to refuse admittance to or expel from Engage if Watermark determines the individual is behaving in a manner that could be disruptive to the event or any other attendee.

General

Watermark reserves the right to change, amend, add, or remove any terms and conditions in its sole discretion and without prior notice, including canceling or rescheduling the event. If one or more of the conditions outlined in these Terms and Conditions should become invalid, the remaining conditions will continue to be valid and apply. These terms and conditions apply to all event participants (e.g., attendees, speakers, sponsors, exhibitors). Submission of registration is regarded as affirmation of all terms and conditions. The views expressed at Engage by any attendee, speaker, exhibitor, or sponsor are not necessarily those of Watermark’s. All Engage event attendees, speakers, exhibitors, and sponsors are solely responsible for the content of any and all individual discussions or presentations, marketing collateral, advertising, and online content. Engage event registration terms and conditions are governed by, and shall be construed in accordance with Texas state law.

Check payments must be in U.S. currency and are due on or before May 8, 2025. Check payments received after this date may be subject to an increased registration fee.

Terms and Conditions

Watermark shall not be deemed in default of this Agreement if circumstances beyond its control interfere with, or prevent Watermark from fulfilling, part or all of Sponsor’s promotional benefits under this Agreement. In no event shall Watermark have any legal and/or financial liability to the Sponsor beyond the agreed sponsorship level. The safety of personnel and exhibit materials from theft, damage, accident, fire, or other such causes are the Sponsors responsibility for insuring. Exhibitors who wish to carry insurance must do so at their own expense.  It is expected that the Sponsor will comply with local, city, and state fire, safety, and health ordinances regarding the installation and operation of equipment. All measures shall be taken by Sponsor to prevent personal injury to spectators and/or the venue. No flammable or hazardous materials should be used in display. Exhibitors agree not to affix items to walls, floors, or other parts of the building or furniture.

Cancellation Policy

If the Sponsor must cancel for any reason, advance written notice must be sent to Watermark. Cancellations are subject to an administration fee of ten percent (10%) of the agreed-upon sponsorship level to cover any publishing, printing, and/or administrative costs incurred by Watermark. No credits will be issued for cancellations on or after May 1, 2025.

Sponsorship Indemnification

Sponsor agrees to defend, indemnify and hold harmless Watermark and its officers, directors, agents, representatives, contractors, and employees from and against any and all third party claims and damages arising out of or related to (i) Sponsor’s breach (or, as to defense obligations only, alleged breach) of this Agreement; (ii) Sponsor’s violation of any applicable law or regulation; (iii) Sponsor’s gross negligence, willful misconduct or fraudulent actions; and (iv) Sponsor’s infringement of the rights (including, without limitation, the intellectual property rights, proprietary rights, rights to privacy and rights to publicity) of any person or entity.

Limitation of Liability

EXCEPT IN CONNECTION WITH THE SPONSOR INDEMNIFICATION OBLIGATIONS, NEITHER PARTY WILL BE LIABLE UNDER ANY CIRCUMSTANCES FOR (A) ANY LOST PROFITS OR OPPORTUNITIES, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR INDIRECT DAMAGES OF ANY KIND, OR (B) DIRECT DAMAGES IN EXCESS OF THE AMOUNT PAID BY SPONSOR TO COMPANY UNDER THIS AGREEMENT.

Use of Sponsor Marks

Sponsor hereby grants to Watermark a non-transferable, nonexclusive license during the Term to use the logos, trademarks, service marks, trade dress, and other protectable source or business identifiers owned by Sponsor and provided by Sponsor to Watermark for use in connection with this Agreement and the Event (“Logos”).  Watermark will only use such Logos as contemplated by Sponsor’s participation in the Event (based on Sponsor’s sponsorship level) or as otherwise permitted by Sponsor.

Intellectual Property and Other Rights

Neither party will acquire any interest in the other party’s trademarks, service marks, trade secrets, logos, commercial symbols, copyrights, patents, and any other intellectual property rights by virtue of the provisions of this Agreement. Sponsor represents and warrants to Watermark that Sponsor has all necessary rights, consents and permissions to collect, share and use Sponsor materials provided to it as contemplated in this Agreement, without violation or infringement of (i) any third party intellectual property, publicity, privacy or other rights, (ii) any laws, or (iii) any other agreement.

*The Event Attendee List will contain the attendees name, title, phone, email address, and company (as provided by the registrant), only if such registrant has opted in to sharing such details. You agree to treat this information as confidential information, and will comply with all applicable federal, state, and local laws related to holding such data.

Miscellaneous

Watermark will design the event in a manner determined by Watermark, in its sole discretion. Sponsor and Company both agree to comply with all applicable laws, rules, and regulations governing its performance under this Agreement, including without limitation any laws relating to the receipt and handling of event attendee information.

Watermark and Sponsor are independent contractors. Each party will each be solely responsible for the conduct of its respective employees and agents in connection with the performance of its obligations hereunder.
